Terms of Service

These Terms of Service ("Terms") govern your use of ComfyAI ("the Service"), operated by Jannik Vitztum ("we", "us", "our"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using ComfyAI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

You must be at least 18 years old to use ComfyAI. By accessing or using the Service, you represent and warrant that you are 18 or older.

We reserve the right to modify these Terms at any time. Material changes will be announced via the Service. Continued use after changes constitutes acceptance.

ComfyAI uses necessary cookies and browser storage to provide the Service, including login, guest sessions, security, consent choices, and local settings. Optional analytics are handled separately and are described in our Privacy Policy.

2. Service Description

ComfyAI provides access to AI language models for conversational purposes. The Service includes:

• Chat functionality with AI models
• Optional user accounts for chat history storage
• Memory features to improve conversation context
• Web search capabilities (when enabled)

Some models may be marked as Testing. Testing models can be hosted on separate infrastructure from our main servers, including temporary evaluation servers provided through services such as RunPod. If you choose a Testing model, the message content and any attachments needed for that request may be routed to that separate server for processing.

3. User Accounts

3.1 Registration

You may use basic features without registration. Creating an account requires a username and password. You are responsible for maintaining the confidentiality of your credentials.

3.2 Account Accuracy

You agree to provide accurate information. We reserve the right to suspend accounts created with false information.

3.3 Account Security

You are responsible for all activities under your account. Notify us immediately at shura@comfyai.de if you suspect unauthorized access.

4. Acceptable Use

You agree to use the Service only for lawful purposes. The following conduct is prohibited:

4.1 Prohibited Content

• Illegal Content: Any content that violates applicable laws, including but not limited to child sexual abuse material (CSAM), terrorism-related content, or incitement to violence
• Malware & Malicious Code: Any attempt to generate, request, or assist in creating malware, exploits, hacking tools, or other malicious software intended to harm, compromise, or gain unauthorized access to systems, networks, or data. This includes but is not limited to: keyloggers, ransomware, trojans, spyware, exploit code, or any code designed for unauthorized surveillance or data exfiltration
• Illicit Activities: Using the Service to plan, coordinate, or assist in illegal activities, regardless of claimed intent, educational purpose, or legality claims. This includes fraud schemes, unauthorized access attempts, and any content that may violate criminal law
• Harassment: Threatening, abusing, or harassing other users or third parties
• Hate Speech: Content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Spam: Automated or bulk interactions intended to abuse the Service
• Fraud: Impersonation, phishing, or deceptive practices
• Circumvention: Attempting to bypass safety features, rate limits, or access controls

4.2 Prohibited Activities

• System Compromise: Any attempt to compromise, attack, or gain unauthorized access to our systems, other users' accounts, or third-party systems. This includes but is not limited to: vulnerability scanning, exploitation attempts, denial-of-service attacks, or any activity designed to test, breach, or circumvent security measures
• Using the Service to generate content for illegal purposes
• Operating a competing service, bulk resale, output brokering, or systematic redistribution of the Service or AI outputs in a way that substitutes for the Service without permission
• Creating multiple accounts to evade restrictions
• Intentionally overloading or disrupting the Service
• Reverse engineering or extracting model weights

5. Content Moderation & Quality Control

We employ automated and manual systems to operate, protect, enforce, and improve the Service.

• Automated systems may flag or filter certain content
• We may review flagged content and user reports
• We may proactively review content at any time, including searching for specific terms or patterns, to ensure compliance with these Terms and applicable law
• We may review conversations, account data, metadata, and related records to assess AI response quality, investigate issues, provide support, and protect the Service
• Authorized personnel may access, preserve, and use relevant content and records where reasonably necessary for moderation, abuse prevention, security, audits, legal compliance, or enforcement of these Terms
• We reserve the right to remove content that violates these Terms

6. Account Suspension and Termination

6.1 Enforcement Approach

We may use warnings, feature limits, content removal, temporary restrictions, manual review, suspension, or permanent termination. We are not required to follow any particular sequence and may skip intermediate steps.

6.2 Termination Rights

Free Service: ComfyAI is provided free of charge. To the maximum extent permitted by law, we may restrict, suspend, terminate, delete, or refuse access to any account, feature, content, or use case at our sole discretion, with or without cause, and with or without notice.

The core service may be offered for free even if optional supporter memberships, donations, or other community support mechanisms are made available separately.

This may include action for safety, abuse prevention, policy enforcement, legal or compliance concerns, operational risk, service integrity, or any other legitimate service-protection reason.

We may immediately terminate accounts without prior warning for severe violations, including but not limited to:

• Illegal content (especially CSAM or terrorism-related)
• Serious harassment or threats of violence
• Attempting to hack or compromise our systems
• Fraud or criminal activity
• Multiple account abuse to evade previous bans
• Any other reason at our sole discretion

6.3 Notice of Termination

When we suspend or terminate your account, we may provide limited information about the action if we choose to do so or where required by law.

For free accounts, we are under no obligation to provide advance notice, detailed reasons, supporting evidence, or a response timeline, except where applicable law requires otherwise.

6.4 Appeals Process

If you believe your account was suspended or terminated in error, you may contact us at shura@comfyai.de to request reconsideration.

We may, but are not obligated to, review or respond to reconsideration requests, except where required by law. Any decision after reconsideration is final.

6.5 Effect of Termination

Upon account termination:

• Your access to the Service is revoked
• Chat history associated with your account may be deleted
• Certain conversations, account data, metadata, moderation materials, security records, deletion-related records, and audit logs may be retained as described in our Privacy Policy
• Creating new accounts to circumvent the ban is prohibited

6.6 Voluntary Account Deletion

You may delete your account at any time through the available account settings or user options at comfyai.de.

Upon deletion, your data will be removed as described in our Privacy Policy.

Account access is removed immediately. Deletion may not remove all residual, administrative, or compliance-related records immediately. For legal compliance, abuse prevention, security, audits, and enforcement, selected account-related records, conversation excerpts, metadata, moderation materials, and related logs may be retained for a limited period, typically up to 30 days, and in some cases longer where reasonably necessary or legally required. Deleted accounts cannot be restored.

7. Intellectual Property

7.1 Our Content

The Service, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

7.2 Your Content

You retain ownership of content you submit. By using the Service, you grant us a limited license to host, store, scan, reproduce, format, review, and otherwise process your input for the purpose of generating responses, operating the Service, moderation, abuse prevention, security, support, audits, legal compliance, and enforcement of these Terms.

7.3 AI-Generated Content

AI responses are generated automatically. You may use AI-generated content for personal and commercial purposes, but you are responsible for ensuring compliance with applicable laws.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee:

• Accuracy or reliability of AI responses
• Uninterrupted or error-free operation
• That the Service will meet your requirements
• Security of data transmission (despite our best efforts)

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages arising from your use of or reliance on AI output
• Actions of other users or third parties

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or EUR 100 if no payment was made).

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Service
• Content you submit or generate
• Your violation of third-party rights

11. Governing Law and Disputes

These Terms are governed by the laws of Austria. Any disputes shall be resolved in the courts of Vienna, Austria, unless mandatory consumer protection laws require otherwise.

For EU consumers: You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

12. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect. Invalid provisions will be replaced with valid ones that achieve the original intent as closely as possible.
