Terms of Service

These Terms of Service ("Terms") govern your use of ComfyAI ("the Service"), operated by Jannik Vitztum ("we", "us", "our"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using ComfyAI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

You must be at least 18 years old to use ComfyAI. By accessing or using the Service, you represent and warrant that you are 18 or older.

We reserve the right to modify these Terms at any time. Material changes will be announced via the Service. Continued use after changes constitutes acceptance.

ComfyAI uses necessary cookies and browser storage to provide the Service, including login, guest sessions, security, consent choices, and local settings. Optional analytics are handled separately and are described in our Privacy Policy.

2. Service Description

ComfyAI provides access to AI language models for conversational purposes. The Service includes:

Some models may be marked as Testing. Testing models can be hosted on separate infrastructure from our main servers, including temporary evaluation servers provided through services such as RunPod. If you choose a Testing model, the message content and any attachments needed for that request may be routed to that separate server for processing.

3. User Accounts

3.1 Registration

You may use basic features without registration. Creating an account requires a username and password. You are responsible for maintaining the confidentiality of your credentials.

3.2 Account Accuracy

You agree to provide accurate information. We reserve the right to suspend accounts created with false information.

You are responsible for all activities under your account. Notify us immediately at shura@comfyai.de if you suspect unauthorized access.

4. Acceptable Use

You agree to use the Service only for lawful purposes. The following conduct is prohibited:

Automatic Enforcement: Attempts to generate prohibited content (especially malware, exploits, or illegal instructions) may be automatically logged, flagged for review, or acted upon and may result in immediate account termination without prior warning.

We employ automated and manual systems to operate, protect, enforce, and improve the Service.

6. Account Suspension and Termination

Important: We may investigate, restrict, suspend, or terminate access at any time to protect the Service, users, legal interests, or platform integrity.

6.1 Enforcement Approach

We may use warnings, feature limits, content removal, temporary restrictions, manual review, suspension, or permanent termination. We are not required to follow any particular sequence and may skip intermediate steps.

6.2 Termination Rights

Free Service: ComfyAI is provided free of charge. To the maximum extent permitted by law, we may restrict, suspend, terminate, delete, or refuse access to any account, feature, content, or use case at our sole discretion, with or without cause, and with or without notice.

The core service may be offered for free even if optional supporter memberships, donations, or other community support mechanisms are made available separately.

This may include action for safety, abuse prevention, policy enforcement, legal or compliance concerns, operational risk, service integrity, or any other legitimate service-protection reason.

We may immediately terminate accounts without prior warning for severe violations, including but not limited to:

When we suspend or terminate your account, we may provide limited information about the action if we choose to do so or where required by law.

For free accounts, we are under no obligation to provide advance notice, detailed reasons, supporting evidence, or a response timeline, except where applicable law requires otherwise.

If you believe your account was suspended or terminated in error, you may contact us at shura@comfyai.de to request reconsideration.

We may, but are not obligated to, review or respond to reconsideration requests, except where required by law. Any decision after reconsideration is final.

You may delete your account at any time through the available account settings or user options at comfyai.de.

Upon deletion, your data will be removed as described in our Privacy Policy.

Account access is removed immediately. Deletion may not remove all residual, administrative, or compliance-related records immediately. For legal compliance, abuse prevention, security, audits, and enforcement, selected account-related records, conversation excerpts, metadata, moderation materials, and related logs may be retained for a limited period, typically up to 30 days, and in some cases longer where reasonably necessary or legally required. Deleted accounts cannot be restored.

7. Intellectual Property

7.1 Our Content

The Service, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

7.2 Your Content

You retain ownership of content you submit. By using the Service, you grant us a limited license to host, store, scan, reproduce, format, review, and otherwise process your input for the purpose of generating responses, operating the Service, moderation, abuse prevention, security, support, audits, legal compliance, and enforcement of these Terms.

7.3 AI-Generated Content

AI responses are generated automatically. You may use AI-generated content for personal and commercial purposes, but you are responsible for ensuring compliance with applicable laws.

AI Limitations: AI responses may contain errors, inaccuracies, or inappropriate content. Do not rely on AI output for medical, legal, financial, or other professional advice.
