Terms of Service
These Terms of Service ("Terms") govern your use of Community AI ("the Service"),
operated by Jannik Vitztum ("we", "us", "our"). By using our Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Community AI, you agree to be bound by these Terms and our
Privacy Policy. If you do not agree, you may not use the Service.
We reserve the right to modify these Terms at any time. Material changes will be announced
via the Service. Continued use after changes constitutes acceptance.
2. Service Description
Community AI provides access to AI language models for conversational purposes. The Service includes:
- Chat functionality with AI models
- Optional user accounts for chat history storage
- Memory features to improve conversation context
- Web search capabilities (when enabled)
3. User Accounts
3.1 Registration
You may use basic features without registration. Creating an account requires a username
and password. You are responsible for maintaining the confidentiality of your credentials.
3.2 Account Accuracy
You agree to provide accurate information. We reserve the right to suspend accounts
created with false information.
3.3 Account Security
You are responsible for all activities under your account. Notify us immediately at
shura@comfyai.de if you suspect unauthorized access.
4. Acceptable Use
You agree to use the Service only for lawful purposes. The following conduct is prohibited:
4.1 Prohibited Content
- Illegal Content: Any content that violates applicable laws, including but not limited to child sexual abuse material (CSAM), terrorism-related content, or incitement to violence
- Harassment: Threatening, abusing, or harassing other users or third parties
- Hate Speech: Content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Malware/Hacking: Attempting to compromise our systems, other users, or third parties
- Spam: Automated or bulk interactions intended to abuse the Service
- Fraud: Impersonation, phishing, or deceptive practices
- Circumvention: Attempting to bypass safety features, rate limits, or access controls
4.2 Prohibited Activities
- Using the Service to generate content for illegal purposes
- Reselling or commercially redistributing AI responses without permission
- Creating multiple accounts to evade restrictions
- Intentionally overloading or disrupting the Service
- Reverse engineering or extracting model weights
5. Content Moderation & Quality Control
We employ automated and manual systems to maintain service quality, safety, and improve our AI.
- Automated systems may flag or filter certain content
- We may review flagged content and user reports
- We may proactively review content at any time, including searching for specific terms or patterns, to ensure compliance with these Terms and applicable law
- We may review conversations to assess AI response quality, identify issues, and improve the service
- We reserve the right to remove content that violates these Terms
6. Account Suspension and Termination
Important: We follow a graduated enforcement approach. Minor violations
typically result in warnings before suspension. Severe violations may result in immediate termination.
6.1 Warning System
For most violations, we follow this process:
- First Violation: Written warning explaining the issue
- Second Violation: Temporary suspension (24-72 hours)
- Third Violation: Extended suspension (7-30 days)
- Continued Violations: Permanent account termination
6.2 Termination Rights
Free Service: Community AI is provided free of charge. We reserve the right to
suspend or terminate any free account at our sole discretion, with or without cause, and with
or without notice. This is a privilege, not a right.
We may immediately terminate accounts without prior warning for severe violations, including but not limited to:
- Illegal content (especially CSAM or terrorism-related)
- Serious harassment or threats of violence
- Attempting to hack or compromise our systems
- Fraud or criminal activity
- Multiple account abuse to evade previous bans
- Any other reason at our sole discretion
6.3 Notice of Termination
When we suspend or terminate your account, we may (but are not obligated to) provide:
- A reason for the action
- Duration of suspension (if temporary)
- Information about the appeals process
For free accounts, we are under no obligation to provide reasons or advance notice for termination.
6.4 Appeals Process
If you believe your account was suspended or terminated in error, you may appeal the decision:
- Send an email to shura@comfyai.de with subject "Account Appeal"
- Include your username and a detailed explanation
- We will review your appeal within 14 business days
- You will receive a written response with our decision
Appeals are reviewed by a human, not automated systems. Our decision on the appeal is final.
6.5 Effect of Termination
Upon account termination:
- Your access to the Service is revoked
- Chat history associated with your account may be deleted
- Certain data may be retained as described in our Privacy Policy
- Creating new accounts to circumvent the ban is prohibited
6.6 Voluntary Account Deletion
You may delete your account at any time by sending an email to:

Upon deletion, your data will be removed as described in our
Privacy Policy.
7. Intellectual Property
7.1 Our Content
The Service, including its design, code, and branding, is owned by us and protected by
intellectual property laws. You may not copy, modify, or distribute our proprietary content.
7.2 Your Content
You retain ownership of content you submit. By using the Service, you grant us a limited
license to process your input for the purpose of generating responses.
7.3 AI-Generated Content
AI responses are generated automatically. You may use AI-generated content for personal
and commercial purposes, but you are responsible for ensuring compliance with applicable laws.
8. Disclaimers
AI Limitations: AI responses may contain errors, inaccuracies, or
inappropriate content. Do not rely on AI output for medical, legal, financial, or
other professional advice.
The Service is provided "as is" without warranties of any kind. We do not guarantee:
- Accuracy or reliability of AI responses
- Uninterrupted or error-free operation
- That the Service will meet your requirements
- Security of data transmission (despite our best efforts)
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Damages arising from your use of or reliance on AI output
- Actions of other users or third parties
Our total liability for any claim shall not exceed the amount you paid us in the
12 months preceding the claim (or EUR 100 if no payment was made).
10. Indemnification
You agree to indemnify and hold us harmless from claims, damages, or expenses arising from:
- Your violation of these Terms
- Your use of the Service
- Content you submit or generate
- Your violation of third-party rights
11. Governing Law and Disputes
These Terms are governed by the laws of Austria. Any disputes shall be resolved in
the courts of Vienna, Austria, unless mandatory consumer protection laws require otherwise.
For EU consumers: You may also use the EU Online Dispute Resolution platform at
https://ec.europa.eu/consumers/odr.
12. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining
provisions remain in effect. Invalid provisions will be replaced with valid ones
that achieve the original intent as closely as possible.
